Each time there is a by-election, BN/UMNO will bring in lots of money there in the name of development and donations to help spur local economy.

Each time there is a by-election, Malaysia DPM will be visiting the constituency and telling jokes.

Each time the DPM open his mouth and tells jokes, he sure spills funny beans... often the beans are seeds of hatred.

This time, the topic is about equality in BN alliance.

Errr... anyone still remember about the choosing of BN candidate for P094 Hulu Selangor by-election?

Remember the DPM override the choice of the entire MIC party?

Ok, perhaps that is UMNO's definition on EQUALITY.

By inference, you should be able to guess its definition on democracy.

DPM: All are equal in Barisan

SIBU: All Barisan Nasional parties, including those from Sarawak, are equal partners who practise power-sharing, said Deputy Prime Minister Tan Sri Muhyiddin Yassin.

“We are brothers, equals in Barisan. They (the Opposition) like to say that Umno is the big bully in the BN but this is not true. It's a big lie to say that Umno bullies other component parties.” he told reporters after a dialogue with teachers and parents at SK Agama Sibu here Monday.

He said just because Umno had more seats in parliament compared to other component parties, it did not mean that the party would sideline their coalition partners.

On calls to raise the oil royalty for Sarawak, Muhyiddin said the Opposition was playing up the issue for political mileage in this Sunday's by-election.

“I have asked the state leaders if the oil royalty was an issue, they said no because the oil royalty is as stated in the constitution,” he said.

One of DAP's seven-point manifesto for the Sibu by-election was to increase Sarawak's oil royalties 5% to 20% if the party and Pakatan Rakyat became the government at the federal level.

Muhyiddin, who is Education Minister, said Pakatan could never be a sustainable government like Barisan because parties within the Opposition alliance had different political ideologies.

In Barisan, he said all parties helped each other and shared a common aspiration to better the nation.

“Pakatan is not sustainable. It's very shaky and the leader, Datuk Seri Anwar Ibrahim, is having a lot of personal problems and court cases,” he pointed out.

Hulu Selangor — Anwar Ibrahim

APRIL 26 — I thank the workers and volunteers from Pakatan Rakyat including our friends in DAP and PAS who supported our candidate in Hulu Selangor, Datuk Zaid Ibrahim.

Tens of thousands of Malaysians joined us to show the people of Hulu Selangor that Pakatan Rakyat is committed to a Malaysia where all of its citizens have the right to peace, justice, and prosperity. I am thankful for the tremendous support you have shown.

Your commitment to change is commendable.

One setback shall not divert us from our goal. Any change worth making is hard and will be fought at every turn. While it doesn’t take away the sting of this loss, there is no road to real change without setbacks along the way.

Over RM100 million was spent by BN to win a thin majority in Hulu Selangor: that amounts to RM65,000 per person. Dozens of ministers campaigned every day; the Election Commission appears guilty once again of violating its mandate to ensure fair elections; and the police intimidated our supporters and there are reports that they even prevented some voters from reaching the polling stations.

This means that Barisan Nasional has learned nothing since the March 2008 election. Character assassination, racism, bribery and brute force may help to win one or two by-elections. But the people of Malaysia will not be deceived.

Our country still faces the same challenges which cannot be resolved by dirty politics or a few catchy slogans. The economy is lagging, jobs are scarce and our education system remains mediocre at best.

We must do more to address the plight of the poor and marginalised people throughout Malaysia. And we must bring credibility back to the Federal government as we have started to do in the Pakatan States.

We increased our popular support in Hulu Selangor. We know we have to do more to reach out to our supporters in the rural heartland, particularly the Felda settlements. I am committed to this challenge and my resolve is unwavering.

Let us look ahead to the next contest and work to bring change to Sarawak.

An Indian now defending the racist PERKASA?

It is very sad to hear that an Indian candidate (from MIC) who is sucking up to the powerful.

And it is probably of his action, he gets the nomination from the ultra UMNO to be BN candidate for Hulu Selangor seat.

MIC and Samy Vellu failed miserably in defending their own choice of candidate (even with an Ultimatum to DPM Muhyiddin), with UMNO playing hardball in the choosing. So much for the equal partnership in BN coalition.

Malaysian Indians have been marginalised by UMNO for over half century, and will continue to be with Indians who sell their souls.

"I suggest you all to take a back seat and think with a clear mind logically. What is the root cause for such economical divide. There are rich Indians and poor ones, same goes for rich Malays and poor ones and so forth. By forcing PR to appoint an Indian as their rep for Hulu Selangor, I find it an absurd move. Discrediting 1Malaysia

Muhyiddin just did a disservice to his boss, Najib’s 1Malaysia. Contrasting glaringly to “People First” in 1Malaysia slogan, (which commonly interpreted as treating all Malaysians fairly,) Muhyiddin declared he is “Malay First, Malaysian Second”.

Muhyiddin’s admission to and declaration of being "Malay First" contemplating to the fact that government will continue to place preferential treatments and priorities to Malays over other races in Malaysia.

Najib's 1Malaysia slogan, will therefore, remains just a slogan, without the support from his deputy.

"I am Malay first but being Malay doesn't mean I am not Malaysian," said Deputy Prime Minister Muhyiddin Yassin.

So, this confirms that the DPM thinks and practices very much differently than the PM Najib in 1Malaysia concept of transforming the government into treating all Malaysian fairly. No wonder there are many around Najib spoke and acted in contrast to the vision laid down by Najib.

And is Najib the only person working hard to promote 1Malaysia campaign which supposedly accords equality to all Malaysians? Looks like a lone ranger.

'How can I say I'm Malaysian first and Malay second? All the Malays will shun me... and it's not proper,' said Deputy Prime Minister Muhyiddin Yassin.

So, in order to gain popularity from Malays, Muhyiddin walks the racial line and does not mind others shun him.

We are talking about stability of a country, economic growth of a country, and democracy of a country.

It is, therefore, so many people continued to support and vote in the incumbent government, again and again.

Many of them, think that by doing so, they help ensuring the equilibrium of stability and economy of the country not be disturbed. And they think the only stability is key to prosper.

Many of them were tricked to believe what they see on the surface.

Many of them were conned on what they hear from the medias.

Unfortunately, they helped flourish the ideas of those cronies and fascists...

So, what have you decided to do, within your rights, to help restore justice and democracy?

The previous Information Minister, Zainuddin Maidin (Zam), told Al Jazeera back in November 2007 that Malaysia is a democratic country because we have elections once every five years. Hitler won the elections as well and became Nazi Germany’s leader. Saddam became Iraq’s leader when he too won the elections. Does this make Nazi Germany and Iraq democratic countries?

In Malaysia, the political arena is not a level playing field. The media is controlled. You need a licence to start a newspaper, magazine or radio/TV station. And if you ‘violate’ the terms of your licence then you lose it. And so-called ‘violations’ are not clear. There is no hard and fast guideline. It is within the powers of the Minister to decide what constitutes a violation. And if the Minister, and only the Minister, is of the opinion that you have violated the terms of your licence then he can cancel it.

So they do not give space or airtime to the opposition for fear of incurring the wrath of the government. And whatever publicity the mainstream print and electronic media gives the opposition it is always in a negative light. Only bad news about the opposition is featured. The mainstream media never says nice things about the opposition. If they do, they will lose their licence.

In a true democracy, the TV stations would give equal airtime to the opposition. This does not happen in Malaysia. In Indonesia, surprisingly, it does. Therefore, in spite of elections being held once every five years, Malaysia has a long way to go in achieving the status of a proper democracy.

KUALA LUMPUR: Bayan Baru MP Datuk Seri Zahrain Mohd Hashim named eight Barisan Nasional MPs and an unnamed deputy Speaker whom he alleged the Pakatan Rakyat leadership claimed would cross over to Pakatan during the attempted Sept 16, 2008 government take-over.

He alleged in the Dewan Rakyat that the MPs from Kalabakan (Datuk Abdul Ghapur Sallehs), Kimanis (Datuk Anifah Aman), Kinabatangan (Datuk Bung Moktar Radin), Tawau (Dr Chua Soon Bui), Sepanggar (Eric Majimbun), Batu Pahat (Datuk Dr Puad Zakarshi), Jerantut (Datuk Seri Tengku Azlan Ibni Sultan Abu Bakar) and Gua Musang (Tengku Razaleigh) were set to cross over.

He told the House that he was disappointed with the Opposition, which had become engulfed with greed and self-interest, and had lost confidence in PKR after the attempted take over.

When Deputy Speaker Datuk Dr Wan Junaidi Tuanku Jaafar asked who the Deputy Speaker was, Zahrain said, “You know, I know-lah.”

Zahrain, who quit PKR and was speaking as an Independent MP in Parliament Thursday, said that PKR Deputy President Senator Dr Syed Husin Ali had slandered him three days ago by saying that the process of cleansing had already been completed and that PKR was cleansed and rid of “grime and shit”.

“I would like to emphasise that God had done the cleansing process in PKR. We who are clean were removed from PKR and what was left was grime and shit,” he said when debating the motion of thanks on the Royal Address.

He advised Syed Husin to read the book Shit by literature Professor Emeritus Datuk Shanon Ahmad.

“Today, in this august House, I would like to expose the shit so that people know and will not continue to be hoodwinked with PKR’s play of politics,” he said.

N. Gobalakrishnan (PKR - Padang Serai) hit out at him by calling him the biggest hypocrite.

“I am willing befriend people who fight me but I won’t befriend people who betray the trust given to them,” he said.

Wan Junaidi reminded MPs not to use the word ‘kamu’ (you) and ‘pengkhianat’ (betrayer).

Tian Chua (PKR Batu) then took out a letter, apparently written by Zahrain to Penang Chief Minister Lim Guan Eng, that he said debunked Zahrain’s purported loss of confidence in PKR after Sept 16, 2008.

Zahrain immediately protested that it was not relevant.

“If it was true that on Sept 16 he (Zahrain) had lost confidence, why did he, in a letter on June 8, 2009, write suggesting that the Pakatan council in Penang should meet once a month so that top leaders could discuss and interact better with each other.

“He had also said: I also suggest that you chair the meeting in Penang,” said Tian Chua.

He urged the Malaysian Communications and Multimedia Commission to investigate MalaysiaKini and Raja Petra’s news portal Malaysia Today which, he claimed, worked hand in hand with the Opposition.

Almost an hour in his speech, Dr Siti Mariah Mahmud (PAS Kota Raja) and Dr Lo Lo Mohamed Ghazali (PAS Titiwangsa) protested that Zahrain had wasted time in the Dewan by repeating what he had said on Wednesday and the Dewan was being misused for political purposes.

Finally, it takes so much courage for Pakatan Rakyat to be the FIRST to propose the restoration of the Local Council Election (popularly being referred as the Third Vote), restoring the rights of the people in choosing their own local representatives, rather than being appointed and used by the winning state governments as rewards to bribe their cronies.

In this regards, again, Pakatan Rakayt outshine and outdo their opponent who governed this country for more than half a century. People with conscience receive well on this proposal, and most NGOs (I mean those truly independent NGOs, not those fed by the ruling parties) have been longing, demanding, and pushing this for decades.

Was it not true that Tun Abdul Razak, 2nd Prime Minister, promised to restore the Local Council Election at the time it was suspended? So, how long do the people have to wait if not now? Another 100 years? More lame execuses?

Come on, embrace the change!

Restore the Third Vote and return the right to choose back to the PEOPLE!

So, how is Malaysia doing after going through more than 10 elections?

This is actually great in demonstrating the human rights. People has the right to bear their bodies for a great cause, such as arts, education, and awareness (i.e. demonstration by PETA).

Don't get it wrong, not promoting pornography here, but doing nude photo shoots in concerted, planned, orderly and controlled fashion are of nothing to worry about. Spencer Tunick and his team did well here.

Don't drag politics and religions into this topic. Don't do it yourselves if your believes against it and learned Muslims at large know the boundary, but embrace the basic rights of humans. Many of the world renowned artworks involves some form of nudity, especially those from Greek civilisation.

Of course, we are not to expose our bodies just for the sake of exposing, or walk around the streets without proper clothings as you like - that is in violations of laws and the civilisation.

Additionally, we ought not look at our bodies as shameful piece of items - which should be an artful creation of god(s) [WHOever your god(s) is/are].

Home Minister declines to meet police shooting victim

A 30-member delegation left Putrajaya disappointed today after Home Minister Hishammuddin Hussein declined to accept their memo in person regarding the police shooting of unemployed single mom Norizan Salleh.

Arriving at the Home Ministry around 11.30am, the group, made up of representatives Lawyers for Liberty and Pakatan Rakyat were met by Hishammuddin's senior private secretary Azmi Zakaria in the lobby to receive the memorandum on behalf of the minister.

However a commotion erupted when Norizan's lawyer N Surendren and the Pakatan representatives insisted on meeting the minister in person.

“If we deliver this to you, you will not take action. We want to hand this to the minister,” declared Surendran.

Apparently annoyed by the remark, the Home Ministry's representative walked away.

Meanwhile, Teratai state assemblyperson Janice Lee said they were treated like nobodies although the victim was already in their building.

Norizan expressed her disappointment that she could not meet the Home Minister in person.

"I still hope to meet him and get explanation from him," she said.

Police had classified the incident as an accident and refused to meet Norizan's medical expenses.

"I do not know how to pay the RM18,000 medical bill," she, adding "I do not even know how to support myself."

PKR communications director Lateefa Koya, wondered why the minister did not take the opportunity to meet the victim himself, so that he could see what she went through.

Norizan, who was shot five times and beaten up by police after they stopped a car she was in on the MRR2, is claiming that attack on her was without reason and wrongful.

Earlier Norizan and her supporters had submitted similar memorandums to Bukit Aman on Feb 5 and the Human Rights Commission (Suhakam) on Feb 11.

Kapar MP S Manickavasagam said they will send the memorandum to Parliament when it sits on March 15.

"He cannot run if it is sent to the parliament," he said.

Among those present to lend support were Selangor exco Rodziah Ismail, Ampang MP Zuraida Kamaruddin, PAS Women's Wing Secretary Kartini Ahmad, Selangor Pakatan Rakyat elected Representative Officer (SELPRO) secretary Ng Yap Hwa.

Wine claimed as ‘food and beverage’, NZ minister resigns

WELLINGTON, Feb 25 – New Zealand Minister of Housing and Fisheries Phil Heatley (pic) on Thursday resigned after misuse of his ministerial credit card was revealed, reports China's Xinhua news agency.

Heatley told reporter at the Parliament that his decision came after he had a closer look at his ministerial credit card expenses for the past 18 months. He said they revealed an error in addition to that already in the public arena.

Heatley claimed money for two bottles of wine, writing food and beverages on the form, after already being caught out for using his ministerial credit card to pay for a family trip.

Heatley has already repaid 175 NZ dollars (US$123) for what he said at the time was for food and beverages at a National Party conference.

Heatley said he was not as familiar with the rules around credit card use as he should have been, and was careless with its use. He has asked the Auditor-General to conduct an independent inquiry into his accounts.

“I want to resign, I haven’t lived up to my own standards,” an emotional Heatley told reporters. He would remain in Parliament as member of parliament for Whangarei region,

New Zealand Prime Minister John Key told a press conference on Thursday that he accepted the resignation with regret. Key said his office has been working with the Audit Office since Wednesday in regards to Heatley’s expense claims.

A full investigation will begin on Thursday afternoon. For the time being, Maurice Williamson and David Carter will take on the housing and fisheries portfolios respectively.

New Zealand Energy Minister Gerry Brownlee also apologised this week and repaid 151.90 NZ dollars (about US$107) spent outside the rules in September, 2009 for a lunch with his electorate staff.

Heatley was the second cabinet minister to resign in the past 12 month. Richard Worth was the first government minister to resign over inappropriate behaviour. – Bernama

"There are three simple tests as to whether Muhyiddin is sincerely and seriously committed to Najib’s 1Malaysia, viz:

Whether as DPM he would agree to the establishment of an Opposition-headed Parliamentary Select Committee on 1Malaysia;
Is he prepared to declare that the basis of 1Malaysia is “ketuanan rakyat Malaysia” and not “ketuanan Melayu”; and
Is he prepared to endorse the objective of 1Malaysia as defined by the 1Malaysia Government Transformation Programme (GTP) Roadmap to create a nation where every Malaysian perceives himself or herself as Malaysian first, and by race, religion or region second – by setting the lead to be the first Umno national leader to declare that he is Malaysian first and Malay second?

If Muhyiddin cannot pass three simple 1Malaysia tests, then he should stop pretending that he is on the same wavelength with Najib on the 1Malaysia concept."

Not the other way round? And this proved clearly that the UMNO/BN has no will in upholding the 1Malaysia agenda but treating it a political slogan to fool the people.

"It is the DAP which has proposed the establishment of an Opposition-headed Parliamentary Select Committee on 1Malaysia which has been met with indifference and disinterest from Muhyiddin and the overwhelming majority of Barisan Nasional Ministers.

This is really quite ridiculous as Muhyiddin and the Najib Cabinet should be persuading the Pakatan Rakyat MPs to agree to the establishment of a Parliamentary Select Committee on 1Malaysia and not the other way round!"

What would be your make of the statement above? -Situation being sharp-eyed by Australian MPs as an obvious conspiracy.

Would these 50 MPs be jeopardising their personal and country's reputations to speak out if not having high enough confidence level of this case?

Last week saw an unusual event in Australian politics: backbench members of Parliament from both sides took a foreign affairs initiative, independent of their party leaderships. Sixty Members and Senators – Labor, Liberal, Green and independent – signed a letter which was presented to the Malaysian High Commissioner protesting against the current trial of Opposition Leader Anwar Ibrahim on charges of “sodomy.”

The letter was signed by, among others, Laurie Ferguson, Malcolm Turnbull, Greg Hunt, Bob Brown, Nick Xenophon, Duncan Kerr, Deputy Speaker Anna Burke, Jennie George, Gary Gray and Mark Dreyfus QC.

It followed a speech which I gave in the House of Representatives on 3 February, in which I drew the House’s attention to the 2nd Sodomy trial in Kuala Lumpur of Anwar Ibrahim.

I’m very grateful to all the Members and Senators who signed the letter. I can’t recall another backbench initiative like this in recent times.

Why should Australian Members of Parliament stick their noses into the affairs of a country like Malaysia, which is a friend and neighbour? I would say it is precisely because Malaysia is a friend and neighbour that we care what happens there. No-one is surprised at show trials and political persecution in North Korea or Burma. When it happens in a country which is one of our region’s relative success stories, we are shocked and dismayed.

Many Australian’s have spoken for Aung San Suu Kyi, Burma’s democratically elected leader under house arrest by an authoritarian regime. In some sense these legal torments of Anwar are more egregious as they are happening in a developing democracy that says organs of the state such as the courts or police should not be used to persecute a democratic political opponent.

People-to-people contact between Australians and Malaysians has become very close in recent years, through students studying in Australia, steadily growing tourism in both directions and growing business ties. The persecution of Anwar Ibrahim, however, does not put Malaysia in a good light.

The repeated attempts by Malaysia’s ruling party to drive Anwar out of politics by framing him up on obviously false charges is a disgraceful story which has now been running for more than ten years. Anwar was Deputy Prime Minister in 1998 when he fell out with the then Prime Minister Mahathir Mohamad – no friend of Australia. He was arrested, beaten up, tried on faked evidence and coerced testimony, then jailed for four years, before his conviction was finally overturned in 2004. Now the same charges have been laid again.

Recently the Wall Street Journal published a first-hand account of how the Malaysian Special Branch police fabricated the charges that led to Anwar’s first trial. Munawar Anees recalled how he had been starved and beaten into signing a false confession which implicated Anwar. The same things are happening again now. It would be intolerable in any democratic country for an accuser to front at the home of the Prime Minister before he then went to the impartial Malaysian police. This is what happened to Anwar Ibrahim when has accuser was succoured by Rosman Razak, the Prime Ministers wife, before he went to charge Anwar at the Police station.

These are the tactics which Anwar’s enemies are willing to resort to, in order to eliminate the threat he poses to those currently in power.

The reason the ruling party UMNO fears Anwar is simply that he is the first Malay politician to challenge successfully its monopoly of the Malay vote, which is the basis of its long-standing hold on power. At the 2008 elections Anwar’s People’s Justice Party and its allies won 60 seats away from UMNO and its allies, creating a viable two-party system for the first time. UMNO fears that he will win the next election unless he is stopped, and it seems that at least some elements of UMNO and their allies in the police are willing to resort to any means to stop him. Their nightmare scenario is for the urban, educated Malays together with Indian and Chinese minorities together with deputies from the rebellious Sabah and Sarawah provinces, uniting to form a parliamentary majority.

Malaysia , however is not like North Korea, sealed off from world opinion. The Malaysian people and the Malaysian government care about their reputation in the region and the world. There have been demonstrations by UMNO ‘youth’ outside the Australian High Commission in Kuala Lumpur. A leading supporter of the Malaysian Prime Minister sought to deflect Malaysian opinion by responding that ‘Michael Danby, who organized the petition is a homosexual’. Sad and pathetic though such a reaction is, the response on many blogs and new sites, by ordinary Malaysians who are outraged at the trial, repudiate such prejudice and show hope for a civic discourse as Malaysia’s democratic ethos develops.

The Malaysian media reports what is said about Malaysia in other countries. That’s why an intervention such as our bipartisan letter to the High Commissioner, politely but clearly setting out our strong protest against persecution of Anwar Ibrahim, can be effective, and why it is such an important initiative. Hopefully when Anwar is free of these torments the best answer to those who would like to keep Malaysia a one party state, will be the peaceful transition to power al la Japan, Taiwan and Korea of an Opposition Government.

When that happens, Australia’s politicians will have done more to cement genuine friendship with Malaysia than oodles of “diplomacy.”

BN, Perkasa protest at Australian mission

KUALA LUMPUR, Feb 17 — The Barisan Nasional Youth and Malay rights group Perkasa gathered separately outside the Australian High Commission here today to protest against 50 Australian MPs who had asked for Datuk Seri Anwar Ibrahim to be freed of his sodomy charge.

BN Youth claimed it gathered 600 members headed by chief Khairy Jamaluddin and his Umno Youth deputy, Datuk Razali Ibrahim for the gathering. Khairy later led a delegation to hand over a protest memorandum to High Commissioner Penny Williams.

The crowd had earlier gathered at a nearby restaurant some 200 metres from the mission as early as 8.30 am and later marched towards the building carrying placards, banners with “Don’t Mess With Our Affairs!”, “Jaga Negara Sendiri (take care of your own country)” written on it.

As they marched, the crowd shouted “mind, mind, mind your own business” and “to hell with Australia”.

A Light Strike Force squad was deployed to form a barricade and prevent the crowd from gathering at the mission’s outer compound.

Only Khairy, Razali and MIC youth chief T Mohan were allowed to pass through the barricade.

Khairy later told reporters that he had met Australian High Commissioner Penny Williams to hand over the memorandum, which among others, demanded the Australian government to make their stand on the issue clear.

“We also want an open apology from the 50 MPs and we want them to retract the petition,” he said.

“This act is a clear interference with our internal affairs and an encroachment to our sovereignty and we will tolerate none of this,” Khairy added.

The BN and Umno Youth chief said the Australian High Commission had assured him that their government has no intentions of meddling with Malaysia’s affairs and are not prejudging the ongoing Sodomy II trial, a charge Anwar and other opposition leaders claimed is “trumped up” to kill its surging influence.

Khairy, however, slammed the accusations and said he believed the ongoing trial will take place in a transparent and fair manner unlike what is claimed by the opposition.

The 50 Australian MPs last week said the Malaysian government should drop the sodomy charge against Anwar, who leads the Pakatan Rakyat opposition pact. Anwar is charged with sodomising his former aide Mohd Saiful Bukhari Azlan on June 26, 2008.

The former deputy prime minister has denied the charge, the second such charge in 12 years.

Perkasa president and Pasir Mas MP Datuk Ibrahim Ali, who led his own members behind the BN Youth, was less diplomatic when stating his view to reporters outside the Australian High Commission.

Ibrahim said the reason why Michael Danby, the MP who led 49 others to hand in the petition calling for the charge to be dropped, is “supporting” Anwar is because he is a homosexual, a derogatory description leveled against Anwar by his political rivals.

“Birds of a feather flock together.I heard that Danby is a homosexual.” The BN Back Benchers Club (BNBBC) also sent a separate protest note at 11.15 am.

BNBBC deputy chairman Kinabatangan MP Datuk Bung Mukhtar Radin handed over their protest memorandum to Williams.

Bung Mukhtar told reporters that Williams had assured them that the views of Danby and the 49 MPs do not represent the Australian government’s stand.

He also said that the Australian MPs should not be carried away by Anwar’s side of the story. The opposition icon has been vigorously engaging the international media in a bid to woo support. “The case is not approached by the government but Saiful,” said the Kinabatangan MP. “Because the case is not broached by the government so how can they ask the judiciary to drop the case?” he added.

Perkasa says ‘anti-Malay’ Guan Eng lied about Prophet’s birthday do

KUALA LUMPUR, Feb 14 — Malay rights group Perkasa today labelled Lim Guan Eng as ‘anti-Malay’, saying the Penang chief minister lied about the purported cancellation of this year’s Prophet birthday march.

Perkasa leader Datuk Ibrahim Ali said Lim overturned the cancellation only when a state government document suggesting the cancellation was leaked to Utusan Malaysia and Umno leaders.

“Lim Guan Eng is anti-Malay. He is the racist. The letters leaked are proof that he had lied,” he told some 250 Perkasa supporters while inaugurating the outfit’s wiranita, Wra and Wirawati wings here.

The Pasir Mas MP, who won the seat on a PAS ticket, also slammed the Islamist party for defending the Penang chief minister on the issue.

Its party organ Harakah had come out to attack Umno-linked newspaper Utusan Malaysia for “twisting” the issue with its report that Lim had intended to cancel the annual procession to mark Prophet Muhammad’s (PBUH) birthday.

The Penang chief minister denied the allegation and blasted the report as “lies”, with his officials saying the leaked document was a suggestion by civil servants in response to another letter asking to revise the birthday celebrations.

The officials said there are three sets of letters, dated Jan 13, Feb 5 and Feb 12, issued by civil servants over the celebrations but the final decision was with the state executive council.

A scanned copy of one letter that bore the letterhead of the state secretariat dated Feb 5 showed the proposal to cancel the procession in favour of a gathering at the Dewan Sri Pinang. The copy was put up at www.rembau.net, the personal website of Umno Youth chief Khairy Jamaluddin.

Utusan carried a report today on what the Rembau MP had said on his blog, that Lim should come clean on the matter.

Ibrahim said PAS in defending Lim and his Penang government has made itself a “tool” for the DAP which he accused them of being chauvinistic and racists.

“These are the real crooks,” he said referring to PAS and added that the Islamist party has betrayed the Malay cause by working closely with the predominantly Chinese DAP.

Ibrahim also condemned the act of 50 Australian MPs who had lodged a formal protest, urging Malaysia to drop sodomy charges against opposition leader Datuk Seri Anwar Ibrahim.

“They are extremely biadap (rude). Who are they to interfere with our affairs? No one in this country is above the law,” lamented the Perkasa founder and president.

Ibrahim, who was detained under ISA with Anwar for a farmers protest in 1974, also chided the PKR leader and the Pakatan Rakyat pact for using the Sodomy II trial as campaign issues despite the ongoing trial.

“This is subjudice to the court. I have never heard of anyone else doing so,” said the former deputy minister in charge of the judicial services, urging members of the public to lodge police reports against those found using the trial as campaign issues.

(The Australian) - MORE than 50 Australian members of parliament, including frontbenchers from both sides of politics, have signed a letter demanding that the Malaysian judiciary drop charges of sodomy against former deputy prime minister Anwar Ibrahim.

Michael Danby (pic), chairman of parliament's foreign affairs subcommittee, delivered the letter to the Malaysian high commissioner, Salman Bin Ahmad, yesterday.

The letter says: "It should be made known to the Malaysian government that in our opinion global esteem for Malaysia will be affected by these charges against Mr Anwar."

The letter further states: "Many friendly observers of Malaysia find it difficult to believe that a leading opposition voice could be charged with sodomy a second time, and so soon after his party made major gains in national elections."

Most of the 50 signatories are Labor members, including two frontbenchers, parliamentary secretaries Gary Gray and Laurie Ferguson. The Deputy Speaker of the House of Representatives, Anna Burke, also signed the letter.

On the Liberal side, environment spokesman Greg Hunt is the most senior signatory, along with former opposition leader Malcolm Turnbull.

Mr Anwar was first charged with sodomy in 1998. He was convicted, but in 2004 Malaysia's Federal Court overturned his conviction.

Mr Anwar was a former deputy prime minister and finance minister under Malaysia's long-serving former leader, Mahathir Mohammed. The two fell out bitterly in the wake of the 1998 Asian financial crisis. Since he was released from jail, Mr Anwar has become the leader of the Malaysian opposition, which made sweeping gains in Malaysia's last federal and state elections.

Such a strong pro-Anwar intervention by so many, and such senior, Australian politicians could well once more inflame the Australia-Malaysia relationship, which went through turbulent times when Dr Mahathir and Paul Keating were their countries's respective leaders. Since then Australia has trodden softly to ensure Malaysian co-operation on trade, military and intelligence, counter-terrorism and regional efforts to stop people-smuggling.

NH Chan, a truly remarkable and learned judge makes all the senses all these while. If only we can have judges or these caliber and unwavering characters, Malaysia's judiciary reputation would not be at its worse.

Chan is a Chinese chap, but why should I (or we) care? Or worry? So long as his comments are fair to all Malaysians and conscientious, we must not look at one's ethnic or religious background.

Did the Federal Court contradict itself in Perak MB ruling?

KUALA LUMPUR, Feb 9 — The Federal Court today may have denied Datuk Seri Nizar Jamaluddin his Perak mentri besar’s post but its just-released collective written judgment is apparently riddled with contradictions, a retired judge said.

Nizar, 53, who had previously been declared the rightful mentri besar, lost the job when a three-man panel of Court of Appeal judges reversed the High Court’s decision last May 22.

The Pasir Panjang assemblyman then took it to the Federal Court and asked the Bench to address three issues based on the Perak Constitution, which, in plain English, translates to:

1. Whether the MB’s post is vacant when he did not resign; none of his peers had passed a vote of no confidence against him; he had asked the Sultan to dissolve the state assembly and start the process for fresh elections and was rejected.

2. Who decides that he has lost the confidence of the state assembly?

3. Who has the right to sack him if he refuses to resign?

The five apex court judges who replied were Tan Sri Alauddin Mohd Sheriff, Tan Sri Arifin Zakaria, Datuk Zulkefli Ahmad Makinuddin, Datuk Wira Ghazali Mohd Yusoff and Datuk Abdull Hamid Embong.

In declaring Datuk Seri Zambry Abd Kadir the rightful Perak MB, the coram summarised their reply, found at the end of 40-pages, as follows:

Yes. (To quote: “The answer to the first question will be in the affirmative;)
Yes. (“As for the second question, our answer is that under Article XVI(6) the question of confidence in the MB may be determined by means other than a vote of no-confidence in the LA;”)
Yes. (“As for the third question our answer is that if the MB refuses to tender the resignation of the Executive Council under Article XVI(6) the MB and the Executive Council members are deemed to have vacated their respective offices.”)

But a closer look at the full judgment, made available to reporters a few hours after the decision was pronounced in Putrajaya, showed several seemingly contradicting statements, prompting a former judge to question the soundness of the top court’s reasoning in one of the most critical cases to affect the highest law of the land — the constitution.

Datuk Chan Nyarn Hoi was puzzled at a certain section that had earlier been read out in open court by the third highest-ranking judge in the country, Chief Judge of Malaya Arifin.

“However, we would add that this is by no means the end of the matter, as it is always open to the appellant [Nizar] to bring a vote of no confidence against the respondent [Zambry] in the LA [Legislative Assembly] or make a representation to HRH [His Royal Highness the Sultan of Perak] at any time if he thinks that the respondent does not enjoy the support of the majority of the members of the LA,” it said.

To the retired Court of Appeal judge, more popularly known as NH Chan, that particular section “sounds strange”.

“On the face of it, it sounds like they are contradicting themselves, isn’t it?” the 74-year-old asked The Malaysian Insider over the phone.

“They say [Nizar] can take a vote of no confidence now, but why couldn’t they do it earlier?” he wondered.

“And if it’s really contradicting, then the whole judgment is rubbish,” he added.

Chan, who now lives in Ipoh, refrained from commenting further until he had read through the full written judgment.

Ku Li says Malaysia is a shame democracy

KUALA LUMPUR, Feb 8 — Tengku Razaleigh Hamzah (picture) called Malaysia a democracy which only existed in name only, and said that reforms could not be expected from the incumbents in power, in an apparent attack against Umno and Barisan Nasional (BN).

“To modify Tunku’s words, we now have a democracy existing in name, but grievously compromised in substance, reality and fact,” Tengku Razaleigh said today when launching Ideas, a new think-tank set up to promote democratic ideals, at the Tunku Abdul Rahman Memorial today.

Razaleigh appeared to also single out Umno and former Prime Minister Tun Dr Mahathir Mohamad in his remarks about the current political situation, and for the attacks against democratic institutions and the judiciary.

He said original founding ideals laid down by Malaysia’s first Prime Minister Tunku Abdul Rahman had been warped.

“We have left it to the deranged for too long ...To expect change from the incumbents is to expect, in the Malay saying, the mice to repair the gourd…‘Bagai tikus baiki labu.’ ”

“Tunku Abdul Rahman was the founder of Malaysia…He brought together a Malaysia that had come together ‘through our own free will and desire in the true spirit of brotherhood and love of freedom’, in a union arrived at ‘by mutual consent by debate and discussion…through friendly argument and compromise,’ and ‘in the spirit of co-operation and concord’,” Razaleigh said in his speech at the launch of the new think tank set up and rooted in memory of the visionary late Kedah prince, fondly called Tunku.

“That basis has been replaced by something alien to it, his memory has been suppressed, and our history revised,” he added.

Razaleigh, more popularly known by his moniker Ku Li, bemoaned how the “founder” would not recognise today’s Malaysia because it has been replaced with the “cult of the great leader”.

“Tunku built up a system of good civil service in which ordinary citizens did not need to see so-and-so to get things done. This has been replaced by a domineering style of leadership in which what you get done depends on who you know.

“In place of the protection for ordinary citizens guaranteed by popular representation, rule of law and the checks and balances of independent institutions, we have the cult of the great leader,” said Razaleigh, who was a close friend of Tunku.

“It is no accident that the erasure of his memory has gone hand in hand with the erosion of our institutions,” he noted further.

Razaleigh pointed out that Tunku did not help Malaysia achieve independence alone but did it with “an entire class of individuals schooled in the culture and practice of parliamentary democracy.”

Shameful Government Fighting for Survival

This Chinese chap (Wong Chin Huat) made good sense in his analysis. He was the person initiated the 1BlackMalaysia campaign with his gang right after the government announced failed 1Malaysia campaign to court the middle ground Malay voters and non-Malay voters.

We should welcome and support his effort, regardless of his ethnicity, in fighting corruption and fair treatment to all Malaysians.

One thing clear is that the incumbent government, in fighting for its survival, would not hesitate to go all out to bring down its challengers.

Look at the advanced countries like UK, US, and France, their governments changed hands over to different political parties from democratic election to democratic election and achieved better transparency in their administration.

Malaysia, has been governed by UMNO and its corrupt allies for more than 50 years. And after more than half a century, we remain unsure of how all races should live together in harmony, has a flip-flopping educational system, a Nazi-styled Home ministry and enforcement agencies, government controlled media mouth pieces, black-box operation on all government linked tenders, etc.

Tonight, I want to speak out on behalf of fellow democrats around Asia, who are flabbergasted at events unfolding in Kuala Lumpur. I refer to the trial which began today of the Malaysian Opposition Leader, Dato Seri Anwar Ibrahim. For the second time, the Malaysian leader of the Opposition, Anwar Ibrahim is on trial for what they call in ancient grating English, ‘Sodomy’. For the second time, the Malaysian legal system is being manipulated by supporters of the incumbent government to drive Malaysia’s best known leader Anwar Ibrahim out of national politics. For the second time, documents are being forged, witnesses are being coerced, evidence is being fabricated.

This trial, like the first trial of Anwar Ibrahim, is a disgrace to Malaysia a country that aspires to democratic norms, where parties change power peacefully and political opponents are not persecuted by organs of the state. Perverting the legal system for political ends by charging Anwar with sexual offences is an affront to human rights. In the first place, the offences with which Anwar has been charged that should not be on the statute book. Australia abolished its laws punishing consenting adult homosexual acts decades ago, as did most advanced countries. It’s long past time that Malaysia also repealed these laws, which it inherited from British colonial times. If these laws did not exist, they could not be used for political purposes as we are currently seeing.

In the second place, everyone in Malaysia, and everyone in the international legal community, knows that Anwar is innocent of these charges. This week the Wall Street Journal published a first-hand account of how the Malaysian Special Branch police fabricated the charges that led to Anwar’s first trial in 1998. Munawar Anees recalled how he had been starved and beaten into signing a false confession which implicated Anwar. Now it’s happening again. These are the lengths to which the corrupt elements within the Malaysian ruling party are willing to go to frame Anwar and remove his threat to their power.

Malaysia is a long-time friend and ally of Australia. Over the past 40 years Malaysia has become an increasingly prosperous and successful multi-cultural society. We continue our friendly and mutually beneficial relationship with Malaysia, which is a deep economic, strategic and cultural relationship.

But Malaysia is also a country of 28 million people who have lived ever since independence more than 50 years ago under the rule of the same party, the United Malay National Organisation or UMNO. UMNO has stayed in power by playing on the Malay fears of the Chinese and Indian minorities. So long as Malaysian politics were polarised even subtlety along racial lines, so long as the Malays voted loyally for UMNO, then the self-perpetuating UMNO oligarchy, who have grown rich through long years of power and through their cozy links to business, would be safe.

That’s why Anwar Ibrahim is such a threat. For the first time Malaysia has a charismatic Malay opposition politician able to appeal to Malay voters and pose a real threat to UMNO’s hold on power. At the 2008 elections Anwar’s People’s Justice Party and its allies won 60 seats away from UMNO and its allies, creating a viable two-party system for the first time. As a result, Abdullah Badawi was deposed as Prime Minister and replaced by Najib Razak, but the threat from Anwar’s coalition continues to grow. So even though the first attempt to frame Anwar on these spurious charged had failed, the corrupt forces within UMNO have decided to try again.

I recently had the privilege of meeting Anwar Ibrahim when he was in Melbourne for the Parliament of the World’s Religions in December. He is an intelligent and articulate and passionate democrat. He is committed to a thorough reform of Malaysian government, to rid it of the cronyism, corruption and authoritarian tendencies that have gained ground since Mahathir Mohammed became Prime Minister in 1981. He is a great, although not uncritical, friend and admirer of Australia. If he were to become Malaysia’s Prime Minister our relationship with Malaysia would become even stronger.

I am pleased that in the last few hours the judge has suspended the case against Anwar for a day. I hope Prime Minister Najib and his ministers are not involved. The best way for them to prove that they are not is to intervene and have these charges withdrawn, and those responsible for fabricating them punished. Malaysia is a great country, and an emerging power in our region. It can do without the embarrassment that these disgraceful proceedings are undermining its newly won democratic credibility.

“Nazri launched a most improper, unwarranted and unprecedented attack on Lau, not only saying that her Dec 31 decision was wrong, but [he was] also maligning and besmirching her judicial competence and role by declaring that she is not a Muslim and had improperly ruled over a matter that concerned the ‘akidah’ (faith) of the Muslim community.

“This is the first time that I know of a judge being attacked on the ground of her religious credentials

rather than her judicial competence and temper — and coming from the de facto Law Minister, it must

be regarded most seriously as a totally unacceptable attack on the independence, impartiality, integrity and professionalism of the judiciary,” Lim (picture) said in a press statement.

The High Court had on Dec 31 last year ruled that the Catholic Church’s Herald weekly had the constitutional right to publish the word “Allah” in its publication, to cater to its Bahasa Malaysia-speaking followers.

The Minister in the Prime Minister’s department and de facto Law Minister questioned Lau’s “Allah” decision because she was not a Muslim and therefore did not understand the “Malay psyche.”

Nazri also stressed that Muslims are constitutionally Malays and the two cannot be separated.

“You must study the psyche of the Malays. The Chinese can be Christian, Hindu, Muslim, Buddhist, no problem, but the Malays, the race itself is defined in the Constitution.

“Who is Malay? In the Constitution, [a] Malay is one: a Muslim; two: speaks Malay; and three: practises Malay culture. In the Constitution, there can’t be [a] Malay who is not a Muslim. Anything at all, any suspicion will confuse the ordinary Malays. They become so protective because Malay and Islam cannot be separate,” Nazri told reporters yesterday.

The DAP advisor, however, rejected Nazri’s claims as a “dangerous perversion and subversion of the Constitution.”

“What is Nazri trying to say? Is he laying down a new law that in multi-religious and multi-racial Malaysia where the Constitution recognises Islam as the official religion but guarantees freedom of religion for all other faiths, non-Muslim and non-Malay judges must be excluded from adjudicating certain cases like the Herald ‘Allah’ case allegedly because it concerns the ‘akidah’ of the Muslim community, and the Malay psyche?

“Fifty-two years after Merdeka and 46 years after the formation of Malaysia, is the country going backwards with a further dichotomy of the judicial system where there is [a] new division of cases which is to be adjudicated solely by judges who fulfil the two conditions of being Muslim and Malay because they fall into the category of [the] ‘akidah’ of the Muslim community and the Malay psyche?

“Will the Court of Appeal and the Federal Court — should the appeal on the Herald’s “Allah” case reach that level — be constituted solely with Muslim and Malay judges to take into account Nazri’s extraordinary objections?” Lim asked.
